What it is
This is the act by which the Congress of the Republic legislates. The Constitution reserves to Congress the power to enact, amend and repeal laws (article 171(a)) and gives it the taxing power exclusively: only a decree of Congress can create a tax and set its taxable event, its base, its rate and its exemptions (article 239). Once published, no executive agreement may contradict it; a lower provision that distorts those bases is void by operation of law. Above it sit the Constitution and the treaties Congress ratifies. The codes, the Foreign Investment Law and the free-zone and maquila regimes all live in this form.
What it can do
Enact, amend and repeal laws; create taxes and set the bases on which they are assessed; approve the treaties that bind the State; and authorize the budget.
What it cannot do
Contradict the Constitution. A law that violates or distorts a constitutional mandate is void ipso jure (article 175), and the Constitutional Court can strike it from the legal order.

What it is
This is the form the President uses when the Constitution itself empowers him to decree, and not merely to regulate (article 183(e)). In today's practice it is the instrument of the states of exception — prevention, alarm, public calamity, siege and war — which the President declares in Council of Ministers when the grounds in article 138 and the Public Order Law are met. The decree must state the cause, the territory and the term, and it goes to Congress, which ratifies, modifies or rejects it. For anyone operating here it matters for what it suspends: movement, assembly and hours, over a defined territory and for a defined term.
What it can do
Declare a state of exception, delimit the territory and the term, and temporarily suspend the guarantees article 138 lists.
What it cannot do
Stand on its own. It must be reported to Congress, which ratifies, modifies or rejects it; it cannot suspend guarantees beyond those article 138 lists, and it cannot run past its term without a fresh decree.
Where it ranks
A presidential act, like the governmental agreement, but on a different footing: it does not develop a law, it exercises a power the Constitution grants the President directly. That is why, for as long as it lasts, it can do what no agreement can: suspend guarantees the Constitution itself lists.

What it is
It is issued by the President of the Republic — in Council of Ministers where a law requires it — and countersigned by the minister of the branch concerned, a condition of validity without which it has no effect (Constitution, articles 183(e) and 194(f)). Its office is to carry out the law: to issue its regulations, organize the administration, and decide what a decree entrusts to the executive, from the regulation of a statute to an appointment, a decoration or the recognition of an entity. The class tells you the rank and the form, never the subject. It cannot alter the spirit of the law it develops, nor create a tax or move the bases on which one is assessed.
What it can do
Issue the regulations of a law, organize the executive branch, settle what a statute expressly delegates, and decide individual acts: appointments, recognitions, authorizations.
What it cannot do
Alter the spirit of the law it develops, or create, waive or grade a tax: that reserve belongs to Congress (article 239). A governmental provision that restricts a constitutional right is likewise void (article 44).

What it is
It is signed by a single minister and governs within the department in that minister's charge. The Constitution and the Executive Branch Law (Decree 114-97) empower a minister to issue what a statute or a regulation expressly entrusts to them: technical standards, schedules of fees, forms, delegations, the internal organization of the ministry. It is the narrowest of the four rungs. It cannot amend a governmental agreement or exceed the regulation that empowers it, and tax matters are closed to it entirely. Its force depends wholly on the norm that granted the competence: repeal that, and the ministerial agreement is left without a base.
What it can do
Issue technical standards, fees and procedures inside its own branch; delegate functions; organize its offices — always within what a statute or a regulation entrusted to it.
What it cannot do
Amend a law or a governmental agreement, create obligations outside its branch, or touch a tax. Anything it issues without express authority is challengeable on that ground alone.

The class does not tell you the subject. A governmental agreement regulates a law and confers a decoration in exactly the same form.
Where each form sits
No norm may contradict the one above it, and the Constitution says so without qualification: a law that violates or distorts a constitutional mandate is void by operation of law (article 175), and so is any governmental provision, of whatever order, that diminishes or restricts a right the Constitution guarantees (article 44).
Constitution of the Republic
Above everything. The Constitutional Court strikes down what contradicts it, and may provisionally suspend a challenged provision.
Ratified treaties and conventions
Congress approves them and they bind the State. On human rights the Constitution gives them precedence over domestic law (article 46); outside that field they are given the force of a statute, and the point is still argued.
Legislative decree
The ordinary statute, enacted by Congress. It is the only rung where a tax is born.
Governmental agreement and decree
Acts of the President. The agreement develops a law without exceeding it; the decree exercises a power the Constitution grants him directly.
Ministerial agreement
An act of a single ministry, valid within what a higher norm entrusted to it.
The order measures the force of each form, not the importance of any one document. A ministerial agreement setting fees can weigh more on an operating cost than a law that was never given its regulations.
