The dossier records eight proceedings with Guatemala as respondent. The State lost and paid in the electricity and railway cases under CAFTA-DR, RDC (US$14.6 million collected) and TECO (US$26,793,001 plus US$838,784 in the 2020 resubmission award), and won where the dispute was characterized as purely regulatory or contractual (Iberdrola I and II, IC Power). In the most recent mining case (Kappes, December 2025) the tribunal found breaches without granting damages, and GEB/TRECSA (more than US$400 million claimed) remains pending. The State's official documentary repository is MINECO's trade defense section. The dossier proposes tracking pending cases and cumulative awards as annual indicators from the UNCTAD ISDS Navigator and the ICSID case database.
