CAFTA-DR has been in force for Guatemala since 1 July 2006 (a date corroborated in the audit of 2026-08-19) and its chapter 10 (investment) has been the basis of most of the claims against the State (RDC, TECO, Kappes). The Spain-Guatemala BIT (2002) was the basis of the two Iberdrola cases; the IC Power and GEB/TRECSA cases invoke instruments with Israel and Colombia whose exact identification is flagged for confirmation. The total number of BITs in force was not obtained: the UNCTAD navigator returned a 403 error when queried and the count must be done by hand. UNCTAD also lists a 'Guatemala – United States ART (2026)' whose nature and status were not identified.
