Which laws and decrees frame investment and its institutions in Guatemala?

Laws: Decree 9-98, the Foreign Investment Act, whose 'ARTICULO 3.- Plena Equiparación' grants the foreign investor the same treatment as that given to domestic investors (text on FAOLEX; number and title also in the Judiciary library catalogue); Decree 29-89,… the Export and Maquila Activity Promotion and Development Act (as cited by its regulation, Government Agreement 533-89, on MINECO's website); Decree 65-89, the Free Zones Act (text on MINECO's website); Decree 22-73, the Organic Act of the Santo Tomás de Castilla Free Industry and Trade Zone (ZOLIC), according to Vestex; Decree 30-2008, which according to ZOLIC amends Law 22-73 and under which the model of the Special Public Economic Development Zones (ZDEEP) is established, although PRONACOM's ZDEEP fact sheet prints 'Decreto 30-2018'; and Decree 16-2010, the Partnerships for the Development of Economic Infrastructure Act (text published by ANADIE). According to the blog of specialist Federico Villalobos, on 25 November 2025 Congress approved Decree 21-2025, which reforms the legal framework for public-private partnerships (PPPs) and was published in La Gaceta on 29 December 2025. Agreements: PRONACOM's website identifies MINECO's National Competitiveness Program (PRONACOM) with Government Agreement 306-2004 and lists its functions under Government Agreement 192-2016; according to the same website, the National Competitiveness Policy 2018-2032 was approved through Government Agreement 103-2018 on Jun 11, 2018; and, according to Prensa Libre, through Ministerial Agreement 295-2024 MINECO created the Agencia de Atracción de Inversión Nacional y Extranjera (National and Foreign Investment Attraction Agency).
