2024Municipalidad de Villa NuevaFor building, you need the municipal building permit (licencia de construcción), although it is not the only municipal permit the sources document. Authorizing it is up to the municipality: the Municipal Code (Decree 12-2002, art. 68, letter e) lists among the municipality's own powers the authorization of building permits for public or private works within the municipality. Other procedures may come before applying for it: according to Prensa Libre (Jul 7, 2023), 9 Executive Branch entities (among them the Health Ministry, MSPAS, and the Environment Ministry, MARN) involved in the assessments for building-works permits, prior to applying to the relevant municipality for the building permit, are connected to the Ventanilla Ágil de la Construcción (VAC, construction fast-track window), and the VAC is useful for procedures that come before the building-permit application. Villa Nueva has its own Construction, Urban Planning and Ornament Regulation, issued by the Municipal Council dated 05 February 2024 and hosted on the municipality's website, whose Regulations page presents the regulations in force that govern construction processes. That regulation defines the Licencia de Construcción de Obra (works building permit) as the document by which the municipality recognizes an individual's or legal entity's right to carry out works within the municipality; its art. 14 requires obtaining it in advance, issued by the Municipality, before starting and carrying out any construction, extension, repair, remodelling or demolition activity, among others, and the regulation includes warehouses (bodegas) in the category of areas dedicated to the production, repair or storage of products. The same regulation defines several kinds of works building permit, among them the minor-construction permit (works and paving of up to 36 m²), the major-construction permit (works and paving larger than 36 m²), and the demolition, earthworks and/or excavation, and urbanization permits, and it regulates other municipal permits: the installation permit (licencia de instalación), for works such as towers, antennas, repeaters and foundation-mounted structures for billboards and/or other advertising (except mini billboards), and the land-use permits (licencias de uso del suelo) mentioned in its art. 110. Its art. 141 sets fees for the assessment, issuance and supervision of works permits according to the building's use, among them 4 % for non-residential use and 4.5% for industrial use and for commercial use; the percentage is calculated on the cost of the works stated in the application or in accordance with the construction cost table the regulation sets out next, which has groups for buildings for industrial facilities, storage warehouses and shopping centres (with metal structure and with built walls). In Guatemala City, according to the same Prensa Libre article, everything related to building permits and related procedures can be handled at the Municipality's construction single-window office (Ventanilla Única), and online one can view requirements for feasibility reports and various types of municipal permits and download forms, at https://vu.muniguate.com/, with an office at 21 calle 6-77 zona 1, Palacio Municipal; that site belongs to the Directorate of Territorial Control, which offers forms and regulations for handling building permits.
