A food exporter to the United States must keep an active FDA registration (renewed every two years; the window runs October-December 2026) and a US agent, under FSMA. The FDA applies DWPE (Detention Without Physical Examination) to products with a history of problems; the risks detected at Guatemalan companies are Cyclospora cayetanensis, pesticide residues, insanitary conditions and incorrect labeling. For snow peas and French beans, FSMA compliance and FDA registration are the real operating license: access has been won, but it carries recurring regulatory risk.
