Provisional suspension of licenses by the Supreme Court

4 Jan 2017

2017Sentencia CC publicada por el MEM

The Supreme Court of Justice provisionally suspended the Oxec I/II licenses in an amparo action for failure to consult the Q'eqchi' people (ruling of 4 January 2017). The Constitutional Court (joined case files 90-2017, 91-2017 and 92-2017, May 26, 2017) allowed operations to continue, on condition that the consultation be held within 12 months. No source consulted invokes 'national interest'. The Q'eqchi' conflict persists: a community leader was convicted and released in 2022.
