Congress Decree 1441 (Labour Code)
29 April 1961
1961Código de TrabajoThe Labour Code in force is known as Decree 1441: the updated edition presented by the Ministry of Labour and Social Welfare explains that the first code was Decree 330 of 8 February 1947 and that Congress Decree 1441 of 29 April 1961 practically replaced it in full. Under its article 14 its rules are public-order norms binding on all enterprises, existing or future, established in Guatemala; under its article 12 any act or clause that waives, reduces or distorts the rights the law grants to workers is null by operation of law. On top of that framework come the monthly employer contributions (IGSS, IRTRA, INTECAP), the aguinaldo, Bono 14, the incentive bonus and severance for unjustified dismissal.
